By the end of 2026, the DEA is almost certainly not going to publish a final, binding rule moving psilocybin or MDMA off Schedule I — the most restrictive category of illegal drugs. The process for doing that is slow, complex, and not close to finished. This means federal law continues to treat these substances the same way it treats heroin.

Resolution rule: YES if, as of 2026-12-31, no FINAL rule rescheduling psilocybin or MDMA out of Schedule I has been published in the Federal Register (federalregister.gov, DEA docket).
