By the end of 2026, the DEA is almost certainly not going to publish a final, binding rule moving psilocybin or MDMA off Schedule I — the most restrictive category of illegal drugs. The process for doing that is slow, complex, and not close to finished. This means federal law continues to treat these substances the same way it treats heroin.
Diversion evidence is mounting, not receding. The bar for administrative rescheduling won't be met this year; any movement is procedural, not final.
